Welcome to ChatCast! These Terms of Service ("Terms") govern your use of the ChatCast platform (the "Service"), provided by ChatCast Inc. ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. The current version of these Terms was last updated on March 20, 2025.
ChatCast allows users to collaboratively chat with an AI via platforms such as email or WhatsApp, transforming those conversations into podcasts or videocasts ("Content") published on platforms like YouTube, TikTok, or others. The Service provides templates and automation, and manages the full content pipeline.
Use of YouTube API Services: ChatCast uses YouTube API Services. By using ChatCast, you are also agreeing to be bound by the YouTube Terms of Service and to Google's handling of your data as described in the Google Privacy Policy.
2. Eligibility and User Responsibilities
You must be at least 13 years old to use the Service and have the legal capacity to agree to these Terms. You are responsible for maintaining the security of your WhatsApp or email account and ensuring that your use of the Service complies with applicable laws and the terms and policies of any third-party platforms (e.g., WhatsApp, YouTube, TikTok).
When submitting materials (e.g., images, audio, YouTube links), you must ensure you have the right to use them and that they do not infringe third-party rights. You are solely responsible for the content you provide.
3. Content Ownership and Licensing
You retain all rights to original content you provide. By uploading or submitting materials, you grant us a worldwide, non-exclusive, royalty-free license to use, process, edit, and publish those materials as part of delivering the Service.
Third-Party Content
If you provide a YouTube link or embed content, you confirm that you are authorized to use it and that its use complies with YouTube's policies. ChatCast may extract and repurpose a portion of that content, subject to your consent and platform limitations.
4. Content Creation and Publishing
Our engine uses automation and AI to generate video content based on your chat interactions and submitted media. The resulting Content will be published to your connected platforms (such as YouTube), using your credentials where OAuth has been granted.
You retain full editorial control of what is submitted and generated. You may customize or cancel publishing before final approval. ChatCast reserves the right to moderate or reject content that violates these Terms or platform standards.
As required by YouTube API Developer Policies, users are able to define values such as title, description, and Privacy Status of videos uploaded to YouTube.
5. Disclaimers and Limitation of Liability
The Service is provided “as is” and without warranties of any kind. We do not guarantee uninterrupted service or flawless AI output. We are not liable for any indirect or consequential losses, platform outages, or data misuse outside our control. Our total liability is limited to USD $100, where allowed by law.
You agree to indemnify and hold harmless ChatCast Inc. from any claims or liabilities arising from your use of the Service or the content you submit.
6. Termination and Changes
You may stop using ChatCast at any time. We may suspend or terminate your access for violation of these Terms or other improper use. We reserve the right to modify these Terms at any time. Changes will be posted on this page. Continued use after updates implies acceptance.
Governing Law
These Terms are governed by the laws of California, USA. Any legal disputes must be resolved in the courts of San Francisco County, California.
